1. List of hazardous chemicals requiring a Chemical Incident Prevention and Response Plan:
As stipulated in Appendix IV of Decree No. 113/2017/ND-CP issued by the Government.
2. Entities required to develop a Chemical Incident Prevention and Response Plan:
Project owners engaged in the production, trading, storage, or use of chemicals where at least one chemical falls under Appendix IV of Decree 113/2017/ND-CP, and where the maximum storage quantity at any one time is equal to or greater than the threshold volume specified in the Appendix, are required to prepare a Chemical Incident Prevention and Response Plan.
The plan must address all hazardous chemicals involved in the project and must be submitted to the relevant sectoral management ministry for appraisal and approval prior to the commencement of operations.
3. Core contents of the Chemical Incident Prevention and Response Plan (As prescribed in Article 39 of the Law on Chemicals)
★ Information on the characteristics, quantities, production or usage technology of chemicals, and the geographical, demographic, and environmental conditions of the chemical activity site.
★ Risk assessment and forecasting of potential chemical incident scenarios plans for monitoring and inspecting sources of chemical hazard.
★ Prediction of chemical incident situations and corresponding preventive measures.
★ Incident response capacity, including equipment, personnel, coordination plans with local emergency forces, and evacuation strategies for people and assets.
★ Incident consequence mitigation plans in accordance with environmental protection laws and other relevant legal regulations.
4. Dossier for appraisal of the Chemical Incident Prevention and Response Plan
★ A formal request letter for appraisal, following the official template.
★ Nine (09) printed copies of the Chemical Incident Prevention and Response Plan.
★ Appraisal and approval period: 22 working days from the date of receipt of a complete and valid dossier by the competent authority (excluding the time required for the applicant to supplement or revise the dossier if necessary).
5. Authority responsible for appraising and approving the Plan:
The sectoral management ministry shall take the lead, in coordination with the fire prevention and fighting authorities, the Ministry of Industry and Trade, and other relevant state management agencies, to conduct the appraisal and issue the approval of the Chemical Incident Prevention and Response Plan.
