I. WHAT IS ON-THE-SPOT IMPORT AND EXPORT CUSTOMS DECLARATION?
On-the-spot import/export applies to goods exported by a Vietnamese trader (including foreign-invested enterprises and export processing enterprises) to a foreign trader, but under the foreign trader’s instruction, the goods are delivered within Vietnam to another Vietnamese entity.
On-the-spot exports are treated as exports, and on-the-spot imports are treated as imports. These transactions must comply with all regulations on the management and taxation of imported and exported goods.
A wide range of goods can be declared under on-the-spot import/export!
To qualify as on-the-spot import/export, there must be two separate contracts:
➜ An export, processing, or lease contract clearly stating that the goods are to be delivered to a recipient in Vietnam
➜ An import, processing, or lease contract clearly stating that the goods are received from a supplier within Vietnam
➜ On-the-spot exporter: The party designated by the foreign trader to deliver goods in Vietnam
➜ On-the-spot importer: The party purchasing goods from a foreign trader and instructed to receive the goods within Vietnam from the on-the-spot exporter
II. WHAT TYPES OF GOODS QUALIFY FOR ON-THE-SPOT IMPORT/EXPORT CUSTOMS DECLARATION?
➜ Processed products, leased or borrowed machinery/equipment, surplus materials, scraps, and defective products as regulated in Clause 3, Article 32 of Decree No. 187/2013/ND-CP
➜ Goods traded between domestic businesses and export processing enterprises or enterprises in non-tariff zones
➜ Goods traded between Vietnamese businesses and foreign individuals/organizations without legal presence in Vietnam, where delivery/receipt is assigned to a third party in Vietnam by the foreign trader

III. REQUIRED DOCUMENTS FOR ON-THE-SPOT IMPORT/EXPORT DECLARATION
➜ Customs documentation must comply with Article 16 of Circular No. 38/2015/TT-BTC
➜ For transactions between domestic businesses and export processing/non-tariff zone enterprises, VAT invoices or sales invoices (as regulated by the Ministry of Finance) are used in place of commercial invoices
